I am a consumer and bankruptcy attorney practicing in Northern California. I work with consumers and small businesses who are in trouble or over-extended with their creditors. On behalf of Consumers and Small Businesses I file Chapter 7 and Chapter 13 Bankruptcy cases.

Chapter 7

If you qualify for Chapter 7 treatment under the Bankruptcy code, you will be able to discharge most, if not all, of your 'unsecured' debt. Unsecured debt includes Credit Cards, Department Store Cards, Payday Advance Loans, and most Judgment debt.

Chapter 13

If you choose Chapter 13 Bankruptcy you agree to repay some portion of your debt. Using the protections of Chapter 13, you can prevent or delay foreclosure of your home.

In Chapter 13, you agree to a repayment plan. This repayment plan will allow you to catch-up on any arrears or late payments you may have on your home. By agreeing to repay the arrears over a period of either 3 or 5 years, you may be able to divide up those payments to a level at which you can get caught up on your home.

Is your home "underwater"? Welcome to the club! However, if your home has more than one "lien" against it - second or third mortgage, judgement liens on your home, home equity lines of credit, etc - Chapter 13 bankrtupcy may allow you to 'strip' these liens from you home. Saving you money on repayment and freeing up your home to go back to earning equity again.

I work in the 3 area bankruptcy courts:

  • In addition to Bankruptcy filings I also handle cases under the Federal Fair Debt Collection Practices Act (FDCPA) and California's own version of that law, the Rosenthal Act. I provide assistance to consumers being harassed by debt collectors and creditors.

    Civil Representation

      Received a Summons? Don't Take a Default!

    I work in both California and Federal Civil Law. Are you being sued? Have you received a court summons? You have a very limited amount of time to respond - typically 30 days from the day you receive it.

    Contact me as soon as possible, I can help.

    Answering and Responding to a court summons is critical. If you fail to respond, the other party will receive a default judgment. This means that the Court will automatically rule against you. The judgment against you will be based only on what the other guy told the court - you will never get a chance to tell your side of the story.

      Have you already defaulted?

    If the judgment has already been eentered against you, I still may be able to help. There is a limited amount of time during which a civil default can be overturned or 'set aside.' If you have a reason that you can offer as to why you didn't respond before the judgment, I may be able to get the Court to 'set aside' or cancel your default. Once the default is set aside, I can file an 'Answer' (or respond) on you behalf.
